Immigration and employment law in New Zealand.

Lawyer vs licensed adviser — what's the difference?v

A Barrister and Solicitor can represent you in court, the Immigration and Protection Tribunal and the Employment Relations Authority. A Licensed Immigration Adviser can only prepare and file visa applications — they cannot appear in court.

Can I appeal a declined visa?v

Yes. Most declined residence applications can be appealed to the IPT within 42 days. Missing this deadline loses the right to appeal. Only a Barrister and Solicitor can represent you at the hearing.

Do I have rights if I am on a temporary visa?v

Yes. The Employment Relations Act 2000 protects all workers regardless of immigration status. Minimum wage $23.15/hr (2026), 4 weeks annual leave, 10 days sick leave.

Is it illegal to threaten my visa if I complain?v

Yes. Criminal offence under Immigration Act 2009 and Employment Relations Act 2000. Contact a lawyer immediately.

What is MBIE mediation?v

Free confidential mediation for employment disputes. Most cases resolve here without ERA proceedings.
